Judge Judith McConnell dismissed the suit by the California EnvironmentalLaw Project on the grounds that it missed the filing deadline by one day.However, the group's attorneys may still have the right to present oral arguments in the case.
The project would be located west of Pacific Street, near the strand. But San Diego-based Manchester Resorts still has a number of steps to take before it can break ground, including a hearing before the California Coastal Commission that is scheduled for October.
