Residents of the adjacent Garden Hills neighborhood had hoped to stop construction on the five million-sf project which includes offices, retail and residential development.

The neighborhood suit, filed against the City of Atlanta and MARTA, which is leasing the three acres for the office towers, contends MARTA is violating state law by using public money to help clear its property and help private development.

MARTA has earmarked $40 million to prepare the property at Lindbergh, site of a rapid rail station and MARTA headquarters. The suit contends the project will affect the neighborhood negatively with traffic congestion.
