Mellon-Stuart is appealing the bench verdict of the eight-day trial to the 11th District Court of Appeal in Atlanta. ADF, a Coral Springs, FL-based steel fabricator, alleges Mellon-Stuart shouldn't have directed the steel work to go up on rain-soaked terrain in 1997, causing additional non-budgeted expense for ADF. The steel contractor alleges numerous design changes ordered by both Mellon-Stuart and Universal also increased its costs for the job. Mellon-Stuart denies the allegations.
Universal is not a defendant in this suit but has been a plaintiff and defendant in other actions against Mellon-Stuart and other subcontractors. Those suits have been settled out of court. CityWalk opened in first quarter 1999.
