The Bellevue, WA-based developer also will add back 100 trees that are four inches in diameter--double the city's required size–-and hire an arborist recommended by the Northwest Gresham Neighborhood Association to create a landscape mitigation plan.

American Property initially applied for permits to clear-cut the site, located north of Division Street and east of Wallula Avenue, near the new Gresham Station shopping center. The neighborhood association kick-started the hearings examiner process by appealing the city's approval of the project, which also was appealed by American Property. Neither side liked the conditions tied to the approval.

Hearings officer Larry Epstein's ruling is similar to the details of a settlement previously negotiated by the city and the developer. The neighborhood association still can appeal the hearings officer's ruling to the City Council.
