The claim stated that design flaws followed by construction delays forced a 97-day delay. The project was completed late and over budget.

County officials agreed to pay Abend Singleton $203,000 for design fees that had yet to be paid. Abend Singleton, now ASAI Architecture, had filed a counterclaim for $1.4 million, but dropped the claim as part of the agreement.

"The county believes this settlement is in the best interest of the taxpayers," said County Executive Katheryn Shields.

The annex construction project was undertaken to comply with federal mandates to ease jail crowding. It was initially budgeted at $18.7 million, but was nearly $6 million over budget and nearly six months behind in completion.

Construction began in 1997, but was stopped soon afterward because of design flaws, including lack of proper piers to support work on the walls.

Walton Construction, the primary construction company on the project, had also filed a $2.2 million claim against the county because of the delays. Last summer, the county paid Walton $1.57 million. Officials said the county will try to recoup that money from Abend Singleton.

In all, the county about $1 million for legal fees and to settle claims.
