William Tuchscher filed the lawsuit in San Diego County Superior Court. According to court documents, the city leaked confidential information about his "exclusive right to negotiate" a deal for the so-called Crystal Bay project on a 127-acre site near F Street. The city leaked the information to a competitor and improperly discussed the information with the Port District, he alleges.

Tuchscher filed the lawsuit as an amendment to a suit filed in November against Lennar Corporations, Lennar Partners and Lennar Communities. He alleges Lennar knew about his exclusive agreement with the city and proceeded to talk to the city about developing the site.
