Last year, the city of North Kansas City cited the owner for property neglect and hired Hunt Midwest Real Estate Development Inc. and the Rainen Coms. to come up with a plan to redevelop the nine-block area that sits north of 23rd Avenue and east of Burlington Street.
The group recommended an $82-million project that called for razing the community's 666 garden apartments and replacing them with 400 apartments, 80 townhouses, 120 senior apartments, 98 single-family homes and six retail sites.
Northgate refused to sell the property to the city. After the North Kansas City Council approved the redevelopment plans, Northgate filed civil and Federal lawsuits against the city. North Kansas City could use condemnation powers to gain rights to the property, but have not done so yet.
In her decision stating that Northgate has endured hardship, then-appellate Judge Laura Denvir Stith wrote, "It is damaged now in a manner that would not be compensable in a later condemnation action." Stith is now a member of the Missouri Supreme Court.
The city has 15 days to file for a rehearing before the appeals court or to ask for a transfer to the Missouri Supreme Court. If neither is done, the case will be sent back to Clay County Circuit Court.
The latest ruling aside, North Kansas City council passed a $5-million contract agreement with Havens Construction Co. of Liberty, MO to make infrastructure improvements. The city also extended the deadline to acquire the property to Dec. 31, 2001.
