666-Unit Multifamily Owner Wins Legal Round

KANSAS CITY, NORTH, MO-An appeals court agrees Northgate Apartments LC will suffer financial hardship as a result of the city's plan to raze and redevelop Northgate Village near 23rd Avenue and Burlington Street.

KANSAS CITY, NORTH, MO-Plans to redevelop the Northgate Village garden apartment community have a new twist. The Missouri Court of Appeals Western District reversed a decision previously made by a judge who dismissed the owner’s lawsuit against the redevelopment. The appeals court agreed with the owner, Northgate Apartments LC, stating the city’s redevelopment plans has caused and will continue to cause financial hardship. About a quarter of North Kansas City residents live in the apartment community.

Last year, the city of North Kansas City cited the owner for property neglect and hired Hunt Midwest Real Estate Development Inc. and the Rainen Coms. to come up with a plan to redevelop the nine-block area that sits north of 23rd Avenue and east of Burlington Street.

The group recommended an $82-million project that called for razing the community’s 666 garden apartments and replacing them with 400 apartments, 80 townhouses, 120 senior apartments, 98 single-family homes and six retail sites.
