Maier & Siebel of Larkspur, the owners of a 19-story, 172,000-sf office structure called the Ward Building at 610 West Ash St., filed suit in San Diego County Superior Court to stop the apartment.

The lawsuit names the Centre City Development Corp., the city Planning Commission and the City Council. According to the complaint, the apartment developer, Leo Frey of Las Vegas, was allowed to turn an 11-story project into a 24-story apartment development.

This elevation allegedly will block Ward building occupants' bay views because the building is on the same block as the proposed apartment high-rise.

The "Allegro Tower" residential development proposed by Frey, already approved, would wall-off the Ward Building from west-facing views, Maier & Siebel claim. Construction could begin in the spring, with completion in late 2003.
