Tuesday, the ballclub sued attorney Bruce Henderson, who has filed numerous lawsuits to block the Downtown ballpark redevelopment project. The Padres filed a malicious-prosecution suit against Henderson in San Diego Superior Court.

The suit accuses Henderson of filing "baseless" lawsuits that were "designed to improperly derail or delay the ballpark project in contravention of the will of the voters," according to the suit.

Padres President Bob Vizas says the suit could "have the effect of killing...probably Major League Baseball in San Diego."

Henderson has lost each of his lawsuits at the trial court level. One remains on appeal.

The Padres' suit seeks compensation and punitive damages "to punish Henderson for his improper conduct and to deter him from engaging in similar acts in the future."

All the lawsuits have halted construction on the ballpark since funding ran out in October 2000. Other factors in the delay were the financial scandal involving former Councilwoman Valerie Stallings and Padres owner John Moores.
