The state appellate court ruled that the city's redevelopment agency has the authority to condemn the property, reversing a Superior Court judge's decision that the city abused its discretion by suing Rados Bros., an Orange County-based engineering firm.
The city wants to acquire three acres of Rados Bros. land on F Street at Bay Boulevard by eminent domain as part of a bayfront redevelopment project.
The San Diego Unified Port District had negotiated a deal with the city and B.F. Goodrich to allow commercial development between H and J streets on property occupied by the aerospace manufacturer.
Goodrich would relocate its storage operations north of H Street. But a condition was that Goodrich would be given the 3.2-acre Rados property, near the manufacturer's campus.
Rados challenged the condemnation, and Judge Sheridan E. Reed ruled in favor of the firm in August 2000. The city appealed the decision. On Dec. 17, the Appellate Court overturned the decision, which was made public this week.
