Robert Simmons filed documents in Superior Court accusing Judge Kevin A. Enright of prejudice. Simmons claims Enright contributed to San Diego Mayor Dick Murphy's election campaign. Simmons also claims Murphy and City Attorney Casey Gwinn attacked him personally during a Dec. 28 press conference.
Enright refused to grant Simmons' request to delay the trial to give him adequate preparation time. Instead, Enright set an expedited trial date of Jan. 28 at the city's request.
Enright made statements that Simmons said were biased, the retired law professor claims.
Simmons contends that changes made to the ballpark project's finance plan by the city in November will require a vote of the people. In 1998, 60% of the voters approved Proposition C, the measure allowing the ballpark.
