GlobeSt.com UPDATE: Atlanta Court Rules Against Pizza Hut

ORLANDO-The 11th District Court of Appeals says the Orlando federal judge was wrong in throwing out a $1.25 million jury award won by an African-American Brevard County family who sued after a receipt with the delivery of a $10 pizza contained a racial slur.

ORLANDO-The Peggy Watson family in Cocoa, FL is getting a second legal shot at Dallas-based Pizza Hut Inc. after the 11th District Court of Appeals in Atlanta ruled Federal Judge Patricia Fawsett was wrong in throwing out a $1.25 million jury award for racial discrimination in September 2000.

The Watsons, African-Americans, sued in August 1998 after a female courier from the Port St. John Pizza Hut, near Cocoa, delivered a $10 pizza to their home. A receipt with the pizza allegedly contained a racial slur and the word ‘stupid’, court records show.

Fawsett’s rationale for trashing the jury award was that corporate officials could not be held responsible for the alleged illegal actions of employees, court records of her order show. The Atlanta appellate court disagreed.
