The road is being widened between First Street and Zanker Road. The council deferred approval on three other necessary parcels until the council's March 19 meeting.

The property acquisitions were made a condition for issuing the Master Site Development Permit requested by Cisco on November 13, 1996. As part of the agreement for the company to acquire property rights over several parcels to add a land on the eastbound side of the expressway to accommodate traffic mitigation, the city agreed to provide real estate services to acquire the necessary right-of-way by either negotiation or condemnation.

At Wednesday's meeting, council staff recommended the adoption of a resolution determining that public use and necessity require the acquisition of the property located at 3080 North First Street owned by First Montague Development Company, LLC; and the property located at 3061 Zanker Road owned by Sahadi Properties, L.P.

The properties being deferred for consideration until next week are 2880 Junction Avenue and 3050 Zanker Road, both owned by Montague LLC; and 3091 North First Street owned by Realtec Properties I, L.P.

Along with the resolutions for property acquisition, the council also directed that temporary 12-month construction easement be issued and that the City Attorney file an eminent domain action to acquire the interests.
