Court Orders Auto Centers to Continue Operating

TROY, MI-The temporary restraining order against Penske Auto Centers, Inc. requires the company to keep its 550 centers at Kmart stores across the US and go about its business as usual.

TROY, MI-The Northern District of Illinois has issued a temporary restraining order against Penske Auto Centers, Inc., requiring the company to continue operating auto service centers at more than 550 Kmart stores across the US. However, both Penske and Kmart appear to have worked out a deal Tuesday toallow the closure of the stores. A formal plan will be submitted to the bankruptcy court Thursday.

The order, signed by Chief Judge Susan Pierson Sonderby, enjoins Penske from taking any action to close or liquidate the auto centers owned and operated by Penske Auto Centers LLC.

The order also prohibits actions to refrain from opening or continuing to operate the auto centers for business as usual.
