The developers of Alves Ranch, a 294-acre site close to the Pittsburg-Bay Point BART and Bailey Road, says that the city approved a new general plan last month, which zoned 35 acres of the property for high-density residential development.

The Alves partners proceeded to take action on their plans to develop a 556-unit apartment complex. However, the city is now attempting to rezone the land for single-family housing, and the Alves partners claim that they arte violating planning law.

According to the Alves developers, general plans are required by state law to set zoning for all land within city limits and cannot have inaccurate or undecided zoning status for parcels of land in any area.

The city's defense is that the status of the parcel of land was undecided when the general plan was executed. On May 6, the city will decide on the zoning status of the land.The lawsuit filed by the Alves partners states that the city should perform a full environmental review if it wants to amend the general plan. It also asks the court to certify the high-density zoning near the freeway and void the approval of the general plan.
