Currently, developers do the hiring. Under the settlement, the Land Use and Housing Committee must consider -- but not necessarily approve -- theproposal.

The suit stems from a lawsuit against the Rancho Encantada master plan property near Poway. The project, developed by Corky McMillin Cos., calls for 828 single-family homes, 106 multifamily units and retail development on about 2,700 acres formerly owned by General Dynamics.

A citizens group led by Craig Bruce Jones filed a lawsuit in Superior Court last summer challenging the adequacy of the project's EIR. Under the settlement, the city must examine a proposal changing the way environmental documents are handled.

The planning and development review director would be responsible for preparing environmental documents. One option would be for the city itself to produce the draft environmental document, while another would be for the city to contract with a consultant to prepare the document.
