Judge Rules for NAIOP and Builders in $20M Impact Fee Suit Against City

ATLANTA-The city lost a motion to dismiss the complaint filed by the local chapter of NAIOP and the Greater Atlanta Home Builders Association. The suit alleges Atlanta is misusing its impact fee revenue from developers.

ATLANTA-U.S. District Court Judge Owen Forrester has ruled against Atlanta’s efforts to dismiss a lawsuit filed by the local chapter of the National Association of Industrial and Office Properties and the Greater Atlanta Home Builders Association.

The plaintiffs charge the city improperly spent more than $20 million in impact fees collected from construction projects on the city’s north side.

Specifically, they argue Atlanta collects impact fees from that area while exempting projects on the west and south sides of the city.
