The suit was brought after the township's Zoning Board of Appeals determined that the gas station was not an "accessory use" of the existing store and therefore was not allowed. Township Supervisor Ralph Maccarone says Township Attorney Bob Seibert is reviewing the matter for the board of trustees, and is expected to mail the board his written opinion for the board's review at an upcoming meeting.

Other Costco warehouses in Roseville, Auburn Hills and Madison Heights have gas stations that offer discounted prices. What makes the Costco gas station unique is that it is only open to members of Costco. A trial date has not yet been set.
