Lawsuit Challenges Zoning Ruling on Costco Gas Station

SHELBY TOWNSHIP, MI-A lawsuit has been filed by the wholesale giant over the township's rejection of a proposed gas station at the Costco store here.

SHELBY TOWNSHIP, MI-A lawsuit has been filed in Macomb County Circuit Court over a commercial zoning dispute in Shelby Township. Costco Wholesale Corp. has filed suit against the township over its rejection of a planned gas station on Costco’s Hall Road property.

The suit was brought after the township’s Zoning Board of Appeals determined that the gas station was not an “accessory use” of the existing store and therefore was not allowed. Township Supervisor Ralph Maccarone says Township Attorney Bob Seibert is reviewing the matter for the board of trustees, and is expected to mail the board his written opinion for the board’s review at an upcoming meeting.
