BARTOW COUNTY, GA-On first glance, it looks like a typical, small-town residents-versus-developer court battle. But area industrial real estate brokers tell GlobeSt.com the Superior Court lawsuit filed by 13 homeowners near White, GA against Osaka-based Toyo Tire Co. is being monitored by brokers, investors and land planners nationally for the implications a victory for the residents might have on comparable land development squabbles in other growing communities.

The suit alleges the six-member Cartersville-Bartow County Regional Industrial Development Authority and commissioner Clarence Brown individually violated the county’s land-use plan Feb. 4 by approving a five-acre agriculture-zoned track to be rezoned for industrial use. The site is part of a 250-acre tract on US 441, about four miles east of Interstate 75 near the town of White.
