Developer to Pay $75,000 in Erosion Dispute

TRAVERSE CITY, MI- William Clous agrees to a settlement after allegations he violated the state's soil erosion laws clearing part of a 360-acre property in the Mitchell Creek Watershed in Grand Traverse County's East Bay Township.

TRAVERSE CITY, MI-A developer and local prosecutor have reached an out-of-court settlement in an alleged violation of the state’s soil erosion law. William Clous made a deal with Grand Traverse County Prosecutor Dennis LaBelle shortly before the scheduled start of a circuit court trial to pay $75,000.

The dispute was over whether Clous had cleared land along the Mitchell Creek Watershed in Grand Traverse County’s East Bay Township, near Traverse City. The county had accused Clous of failing to obtain a soil erosion permit before clearing part of a 360-acre property in the watershed. Clous contended he didn’t need a permit because he planned to farm the land, and the law granted an exemption for agriculture. Circuit Judge Thomas Phillips ruled last October the exemption didn’t apply.
