Court appeals were submitted by IOC Pittsburgh Inc., which represents a proposal by St. Louis-based Isle of Capri Casinos Inc.; and Station Square Gaming LP, a partnership of Cleveland-based Forest City Enterprises and Harrah's Entertainment, both of which were denied the one license available for a standalone slots parlor in Pittsburgh. The selection of PITG Gaming LLC, which is led by Detroit-developer Dan Barden for a Majestic Star Casino, prevailed.

"The board had a very difficult task of choosing only one licensee from the three excellent applicants in Pittsburgh," says Tad Decker, PGCB chairman, in a statement following the ruling. "But, as the court affirmed, our process and decision to award a license to Mr. Barden and PITG Gaming was correct."

The court also struck down an appeal by Matzel Development's unsuccessful bid for a license at Pocono Manor, which challenged the selection of Mount Airy #1 LLC, a proposal submitted by Louis DeNaples' Mount Airy Resort & Casino for a $400-million facility that will also include a 400-room hotel.
