A New Jersey appeals court has ruled that a clause in a contract that mandates that any dispute resolved by Russians courts is enforceable, even though there is little likelihood that one of the parties will return to Russia to resolve the dispute. The two-judge Appellate Division panel, in an unpublished decision released June 17 in Ogorodnikov v. Dikker , said there was no reason to overturn a trial judge’s decision to dismiss a lawsuit filed in New Jersey for lack of jurisdiction. According to GlobeSt.com sister publication, ALM’s New Jersey Law Journal , “[F]orum selection clauses are valid and enforceable in our courts,” said Appellate Division Judges Susan Reisner and Richard Hoffman. The article stated that Ogorodnikov and Dikker are involved in a commercial real estate dispute that involves property in Russian, according to Ogorodnikov’s attorney, Medford solo Paul Leodori. Ogorodnikov is seeking about $10 million in damages. Leodori said Dikker fled Russia and now lives in Mahwah. Leodori said Dikker “fears for his safety” because of business dealings in Russia with others not involved in this case, the article says. Click here to read more on the lawsuit and full article.
